Presidential Guidance updates Vento bands for injury to feelings awards
In relevant claims where injury to feelings is a feature in the award granted (such as discrimination), the award is calculated on the basis of the “Vento bands”.
Presidential Guidance has just been updated to uplift the bands in such cases, and therefore for claims presented on or after 6 April 2019 the bands will be:
- lower band of £900 to £8,800 for less serious cases
- middle band of £8,800 to £26,300 for cases that do not merit an award in the upper band
- upper band of £26,300 to £44,000 for the most serious cases
- awards may exceed £44,000 only in the most serious of cases.
Awards for injury to feelings sit alongside other potential awards that a claimant may seek to recover, but it is worth being mindful as an employer or an employee of the potential value (and potential limit of the value) of any claims that may be or are brought at every stage of proceedings.
